{"id":351,"date":"2005-06-18T11:05:47","date_gmt":"2005-06-18T15:05:47","guid":{"rendered":"http:\/\/shermandorn.com\/wordpress\/?p=351"},"modified":"2005-06-18T11:05:47","modified_gmt":"2005-06-18T15:05:47","slug":"klocek-defamation-suit","status":"publish","type":"post","link":"https:\/\/shermandorn.com\/?p=351","title":{"rendered":"Klocek defamation suit"},"content":{"rendered":"<p>Former Depaul University adjunct Thomas Klocek has <a href=\"http:\/\/www.washingtonpost.com\/wp-dyn\/content\/article\/2005\/06\/14\/AR2005061401381.html\">filed a defamation lawsuit<\/a> against DePaul.  <a href=\"http:\/\/www.thefire.org\">Foundation for Individual Rights in Education<\/a>&#8216;s David French <a href=\"http:\/\/www.thefire.org\/index.php\/article\/5790.html\">comments on the lawsuit<\/a> on FIRE&#8217;s blog.  As I&#8217;ve <a href=\"http:\/\/www.shermandorn.com\/mt\/archives\/000263.html\">noted before<\/a>, the key  issue here is not that DePaul fired Klocek without due process (since adjuncts have few procedural rights at universities&#151;whether they should is a different issue) but that they did so for illegitimate reasons.  When the administration said they had fired him for what he said (and then covered that with a flimsy pretext), they were damaging his reputation in the most stupid way possible.  From the Washington Post report, Klocek isn&#8217;t suing them for the dismissal <em>per se<\/em> but defamation.  This is lawyer-speak for, &#8220;I can&#8217;t sue you for your core sin, but I <em>will<\/em> sue your heinie off for the associated sins that are actionable.&#8221;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Former Depaul University adjunct Thomas Klocek has filed a defamation lawsuit against DePaul.
